In a significant breather for comedian Kunal Kamra, the Bombay High Court has granted interim protection from arrest till April 16, taking a measured stance on the controversial FIR filed against him for allegedly calling Maharashtra Deputy CM Eknath Shinde a “traitor” during a comedy act.

Turning the spotlight on freedom of expression in satire, a division bench of Justices Sarang Kotwal and S M Modak issued notices to the Mumbai Police and Shiv Sena MLA Murji Patel, who had filed the complaint. The court has asked both parties to respond before the matter is heard in full next week.

Kamra, known for his sharp political humour, has challenged the FIR, stating it arose from a comedy performance—not a criminal conspiracy. His counsel, senior advocate Navroz Seervai, highlighted that Kamra has been residing in Tamil Nadu since 2021 and has made multiple offers to join the police investigation virtually, citing safety concerns if made to travel in person.

“It appears the aim is more about compelling his physical presence than genuinely recording his statement,” Seervai told the court, reaffirming Kamra’s cooperation.The Madras High Court had already extended interim anticipatory bail to Kamra till April 17, giving him a legal cushion amid the unfolding case.

The Bombay HC’s decision reflects a cautious approach, balancing the need for investigation with the comedian’s right to safety and freedom of speech. As the matter is now slated for detailed hearing on April 16, all eyes will be on how the court navigates the sensitive intersection of satire and political sentiment.
