Historic Verdict: Government Medical Officers in Maharashtra Barred from Private Practice

Mumbai, August 3: In a landmark ruling, the Aurangabad Bench of the Bombay High Court (Chhatrapati Sambhajinagar) has upheld the Maharashtra government’s policy prohibiting government medical officers serving in the Public Health Department from engaging in private medical practice. The judgment, delivered on July 30, 2026, also dismissed all long-pending petitions challenging the policy.

The High Court observed that government medical officers are governed by the Maharashtra Civil Services Rules and the state’s service regulations, which require them to devote themselves exclusively to full-time public service. Consequently, the Court ruled that they cannot be permitted to undertake private medical practice while in government employment.

The ruling is expected to significantly strengthen Maharashtra’s public healthcare system by ensuring the full-time availability of government doctors in public hospitals and healthcare facilities. Officials believe the decision will improve patient care and enhance the delivery of medical services in both rural and urban areas.

Representing the State Government, Assistant Government Pleader Atul Kale effectively argued the case before the Court. The Health Department’s legal adviser, Advocate Satish Bhendekar, played a key role in presenting legal submissions, coordinating documentation, and providing comprehensive legal support to the government’s case.

According to legal experts and public health professionals, the judgment marks a major step toward reinforcing accountability, discipline, and patient-centric governance within the state’s healthcare system. The Health Department described the verdict as a historic decision that prioritizes public interest and strengthens the quality and integrity of government healthcare services across Maharashtra.
